B.L.M. has recognized that fact and has cooperated in our generation <br />of detailed plans for the operation and restoration of the proposed shallow-surface, <br />phased mining activity at the subject site. <br />As a member of the public, the commenter has every right to access the public land <br />premises for whatever visual survey she wishes to conduct. At this time, until <br />withdrawn and fenced for special mining use, the only restrictions we la~ow of involve <br />the protection of historical resources and other general land use regulations of the B.L.M. <br />involving off-road vehicle use, fire safety, etc. The sand & gravel and minerals owner <br />also has certain rights regarding surface use of these lands, which include the lawful <br />exploration and development of his owned resource without harassment from the public. <br />Careful examination of the reclamation permit application on file at the Montezuma <br />County Courthouse Recorder's Office and of the Colorado Mined Land Reclamation Law <br />should answer any relevant questions of the public concerning Stone Gravel Pit's <br />application. Concerns regarding public safety and health, use of tax-supported public <br />roads, nuisance factors, multiple-use of public lands, aesthetics, land planning & zoning, <br />among others, are not issues to be addressed by the Board or the Division staff. Such <br />• issues if allowed a forum at Mined Land Reclamation Board conferences and hearings <br />inflict a grave injustice upon the permit applicant. Such issues, although given the <br />gravest consideration before the appropriate agency, cannot be addressed to resolution <br />before the Board or staff without the participation of the appropriate agency of <br />jurisdiction. Inappropriate issues being aired before the Board introduces a very <br />damaging chance of undue prejudice towazd the applicant.
