• SEDIMENT POND NO.008 <br />PERMANENT IMPOUNDMENT DEMONSTRATION <br />In conjunction with Technical Revision 37, SCC has applied for approval of Sediment Pond 008 as a <br />permanent impoundment to support the post [Wining land use of livestock grazing and wildlife <br />habitat Under applicable provisions of Rule 4.05.9(]3), Sediment Pond 008 must meet the following <br />criteria: <br />(a) The quality of the impounded water shall be suitable on a permanent basis for its intended <br />use, shall meet applicable state and federal water quality standazds and discharge of water <br />from the impoundment shall meet applicable State and Federal effluent ]imitations and shall <br />not degrade the quality of receiving water below applicable stream standazds; <br />(b) The level of water shall be suffidendy stable, and the configuration of the pond shall be <br />adequate, to support the intended use; <br />(c) Adequate safety and access to impounded water shall be provided for proposed water users; <br />(d) Water impotmdments shall not result in the diminution of the quality or quantity of water <br />available to water right holders for agricultural, industrial, recreational, or domestic uses <br />except in accordance with applicable state law; <br />(e) The size of the impoundment shall be adequate for its intended purposes; <br />• (f) The impoundment shall be suitable fox the approved post-mining ]and use. <br />Detailed discussions and relevant information is presented in various sections of Tab 7, Hydrology. <br />The following is a stunmary of the details contained in Tab 7. <br />Rule 4.05.9(13)(a). Pond 008 discharges to Bond Creek, which is tributary to Fish Creek. CDPHE <br />has detennnted that beneficial uses include aquatic life and agricultural uses. Consequently, <br />impoundment effluent has been compazed to aquatic life and agricultural standazds. <br />Table 7-117, Comparison of Pond 004 and 008 Effluent Quality to Yampa Segment 14B Standazds, <br />summarizes Pond 008 effluent exceedences of the stream standards from 1999 to 2004. Table 7-I17 <br />indicates that the effluent quality from Pond 008 is suitable to support aquatic life and agricultural <br />uses and will not impact water quality in Fish Creek. (See -Seneca 11 Technical Retdrion 37 (2005) <br />Permanent Impoundment Water,Quality and Water Rsght Demonrtrationr, page 7-385) <br />Rule 4.05,9(]3)(6). Pond 008 is generally oval shaped. This configuration is typical of stock water <br />impoundments throughout northwest Colorado. The pond receives perennial inflow from seeps and <br />springs, as well as snowmelt runoff during spring months. The pond is fitted with a principal <br />spillway that controls the permanent pool elevation. (Exhibit 7-17E, Pond 008 Principal Spillway <br />Replacement As-BuikJ <br />Rule 4.05,9(13)(c). The pond has relatively shallow inslopes (3H:1V or shallower). There aze no <br />cliffs or steep dropoffs along any pond margin.
