•n- <br />LING REQUIREMENTS: <br />Ia order fo apply for a Reclamation Ptrmit for a Regular ] 12 Operation, please provide: <br />_ One (I) signed anti notarized completed ORIGINAL and one (1) copy of the completed original Regular 112 <br />Operation Application Form. ORIGINAL SIGNATURES MUST BE DONE IN BLUE INK <br />° Two (2) copies of Exhibits A-S, (required sections desenbed in Rule 6). <br />° Two (2) copies of Addendum 1 -Notice requirements (described in Rule 1.6.2(1x6)). A sample of this notice is <br />attached for your use. <br />° The l,reotechnical Stability Exhibit when required by the Division <br />_ ° The application fee. <br />The ninety (90) day period for review of the application and exhibits will ~ begin until all required information and fee are <br />submitted. The Office will then review the submitted information for adequacy. <br />NOTICE REQUIREMENTS: <br />- 1. You ST send a notice, on a form approved by the Board, to the local board of county commissioners. A copy <br />• of this 'Notice of Filing Application" form is attached for your use. <br />_ 2. If the mining operation is within the boundaries of a conservation district, send a notice to the board of <br />supervisors of the conservation district, PRIOR to filing the application A copy of this'Notice of Filing Application" <br />form is attached for your use. <br />3. You MIST include proofofaotice #1 and #2 above with the application at the time the application is submitted <br />w the Office for filing (Rule 1.6.2(1)(p~). <br />4. PRIOR to &ling the applic~ion, place for public review a copy of the applicatioq less cemfideatial items, wilt the <br />clerk or recorder of the county or counties in which the affected land is located <br />5. You MUST include an affidavit or receipt demonstrating that the application was filed with the county clerk or <br />recorder at the time the application is submitted to the Office for filing. <br />,_ 6. A~ changes or additions made to an application submittal ST be filed with the county clerk or records. You <br />MUST also provide the Office with an affidavit or receipt demonstrating that the change was filed with the county clerk <br />or recorder no later than the close of business on the day the change was filed with the Office (Rule 1.8.1(2)). <br />7. ~thia ten (i0) days after your application is considered filed, you must publish four times in a newspaper of <br />general circulation, in the locality of the proposed mining operation, the notice described in Rule 1.6.2(1){d). <br />8. In addition, after the fast publication you must mail or personally serve a copy of the notice described in <br />Rule 1.6.2(1)(d) to all owners of record of surface rights to the affected land and all owners of record of lands that are <br />. within 200 feet of the boundary of the affected land (Rule 1.6.2(1)(e)). A copy of a form which includes all required <br />information for the notice is attached for your use. <br />
