Spillers for <br />the proposed mine located at Section <br />3, Township 35 North, Range 7 West, <br />N.M.P.M., County Roads 501 and 502. <br />Gentlemen, <br />La Plata County has previously provided you with our <br />standard observations to the effect that the above applicant <br />was not in violation of existing County regulations due to the <br />fact that La Plata County possesses no zoning ordinances. <br />The purpose of this letter is to emphasize the fact that <br />although this County is presently unable to regulate this appli- <br />cation, the Board of County Commissioners neither supports this <br />applicant nor do they believe this application complies with <br />state law. <br />La Plata County had previously considered making an <br />application for gravel we desperately need in this particular <br />location for road improvements, but the Board of County Commis- <br />sioners decided that they should not be a part of any further <br />use of a pit located within 200 feet of a residence and there- <br />fore operating in violation of state law. The Board has de- <br />cided not to use any gravel from this pit and not to support <br />any type of continued use of this location. They are hopeful <br />that your actions will protect the adjacent property owner's <br />rights which they find themselves unable to protect by local <br />regulations. <br />
