The Rockcastle Company agrees to a diversity standard of "at least four <br />• perennial grasses and one perennial forb", as requested by the Division. <br />A species diversity success criterion is proposed based on the Colorado Mined <br />Land Reclamation Division's Proposed Policy for Evaluating Species Diversity <br />as follows: <br />Diversify will be based on cover data. Revegetation will be considered suc- <br />cessful if the data demonstrate the presence of at least five perennial spe- <br />cies with relative importance of at least 3 percent, with all of these species <br />combined not exceeding /5 percent relative importance, nor any one of these <br />species exceeding 40 percent relative importance. <br />Criteria for woody plant density and diversity are not proposed at this time. <br />The Rocvca~tle Company understands that grazing is not permitted on reclaimed <br />areas without the approval of the Division. The Rockcastle Company will <br />endeavor to restrict grazing on reclaimed areas, as previously described, <br />• during the term of the permit, until grazing has been approved. <br />A letter, dated November 26, 1983, has been transmitted from Mark L. Korb, <br />attorney for The Rockcastle Company, to Dan Mathews of the Division of Mined <br />Land Reclamation, in which efforts to control livestock grazing were outlined, <br />as well as some historical background on the situation. <br />Based on that letter, the following plan is proposed if areas around the mine <br />are leased for grazing in the future: <br />1. Keeping contact with the surface owner to determine whether or not there <br />will, in tact, be grazing in 1984. <br />2. If no grazing is contemplated no further action will have to be taken. <br />3. If grazing does become known as a probable use, we will propose to <br />identity and delineate the areas where grazing could be permitted and, if at <br />all possible, strictly prohibit grazing any place above the juncture in the <br />former fit access road where the pet access road comes into the the main haul <br />road adjacent to Grassy Creek. <br />4. When the sheep are brought to the site, the sheepherder would be specifi- <br />• cally shown the prohibited areas and given specific requests to avoid per- <br />mitting sheep to get into those areas. <br />12/87 II.J-llb <br />
