Permit Application Package
Deaz Mr. Rivera:
On July 21, 2004, the Division of Minerals and Geology received your the 110 Constmction Materials Reclamation
Permit Application package for the Riveras Excavation Gravel Pit, File No. M-2004-053. On July 30, 2004, the
Division of Minerals and Geology sent you a letter addressing some items that were found to be inwmplete. The Division
received additional information pertaining to those missing items in the initial application on August 23, 2004. Further
review of the application package received on July 21, 2004 has determined that tern copies of the following items must
be received before the Division can begin the technical review of your application:

Application Page 1 shows the "ApplicanUoperator or company name (name to be used on permit" as Eleuto Jce
Rivera. On Page 3 and 6 you show the "APPLICANT/OPERATOR (name, address, and phone of name to be
used on pemut)" -Company Name of "Rivera's Excavation". The ApplicanUOperator name must be consistent
throughout the application and exhibits. If you want the permit issued to Rivera's Excavation than wherever
you see the word "Operator" you must put "River's Excavation". If you want the permit issued to Eleuto Jce
Rivera then you must put his name wherever you seethe word "Operator"
The application form that you submitted was missing pages 4 and 5 and the notarization of your signature is
inwmplete.
The Division is sending you a blank application form. You must complete the entire application and sign the
application in front of a Notary Public. The Notary Public must properly complete the notarization of your
signature. A copy of the completed application must be submitted to the Costilla County Clerk and Recorder
for public review and you must submit a receipt, showing the date that the copy was given to the County Clerk
and Recorder, to the Division of Minerals and Geology along with the original signed applicaton and a copy.
Your application will not be considered filed until the information listed above is received and found sufficiem to begin
our review. A decision date will be established 30 days from the date of receipt of all of the requested infomlation.
Additionally, if you have already published notice you will need to republish notice, after the Division considers the
application submitted. Republication must occur once within ten (10) days of the submittal date. We will notify you
when you should initiate republication of your notice. The final date for receiving comments is ten (10) days after the
date of publication or the next regular business day.
