<br />MINUTES <br />AGENDA ITEM 45 -MATHIAS CONCRETE, FILE N0. 83-175 <br /> <br />PAGE 15 <br />Staff presentation was made by Reclamation Specialist, Mike Stanton, regarding <br />a proposed 8 acre sand and gravel operation located about 3-1/2 miles northeast <br />of Alamosa. The Division received the application on September 1. On the 9th <br />of September a complete letter was sent to the operator. The operator did not <br />receive that complete lf:tter until the 15th of September and therefore did not <br />have time to meet the statutory requirements for publication and notification. <br />Operator has requested that the board consider the application. One publication <br />occurred on Monday, September 19th, the second will appear on September 26. <br />Adjacent landowners have been notified but no response has been received from <br />them. Staff recommended approval of the application with bond set at $5,000 <br />with a stipulation regarding receipt of objections. <br />It was MOVED that the board approve the application of Mathias Concrete, <br />File 83-175, with the condition that no objections are received by the staff <br />by Friday noon, Septemb~ar 30th, with bond set at $5,000. SECONDED and <br />PASSED UNANIMOUSLY. <br />AGENDA ITEM 40 -UNION CARBIDE, FILE N0. 77-285 <br />Staff presentation was made by Reclamation Specialist, Mike Stanton, indicating <br />that the operator has r~aquested continuance on consideration of their application <br />and the company has also requested that they be allowed to make a presentation <br />before the board at the November Board Meeting to provide information regarding <br />all their Uravan area operations. <br />It was MOVED that the operator's request for continuance to the November Board <br />Meeting be approved. SECONDED and PASSED UNANIMOUSLY. <br />AGENDA ITEM 43 -EARTH SCIENCES, INC., FILE N0. 79-21 <br />Staff presentation was made by Reclamation Specialist, Mike Stanton, regarding <br />an application which was approved at the July Board Meeting with bond set at <br />$177,000. The operator has requested that a phase bonding arrangement be <br />considered. Operator proposed $88,000 current for affected lands and add <br />$14,833.33 each year for additional acreages to be disturbed. Staff recommended <br />approval. <br />It was MOVED that the operator's request for phase bonding as outlined by the <br />staff be approved by the board. SECONDED and PASSED UNANIMOUSLY. <br />
