,.
need information on the nature of the site and its proximity to roads, specifically. For example,
is the welt to be drilled in a pasture, sagebrush, willows, or some other environment. Will the
well be located within 50 feet of a paved county road, on the shoulder of a dirt 2-track road, or
some other indication of the proximity. If the well is 50 feet from the road, what is in between
the road and the well site? Cleazly the drilling will be done in the spring when sofr ground and
mud is a potential problem. So please indicate, by a combination of site description and
condition description, what measures will be taken to insure that these sites will be in good
condition when your done drilling.
The response to rule 2.02.2 (g) is satisfactory.
Regazding rule 2.02.2 (2) (h), the explanation is insufficient. Some of the wells will be neaz
drill sites that have already been cleazed for the existing NOIs to which you refer. However,
some aze as much as a mile away from any of those sites. It will be necessary to have each site
evaluated by the appropriate agencies -the US Fish and Wildlife Service and the Colorado
Division of Wildlife - in order to satisfy the requirements of this rule. You can make your case
to them as best you can as to whether a site is close enough to a cleared site to be considered
cleazed. That is their call, not ours. If the stipulations placed by the CDOW for those other NOIs
apply to any of these sites, we must know which sites specifically they apply and have cleazance
for the rest.
Please feel free to call at any time with questions. We recognize you want to get this program off
the ground soon, so we will attempt to expedite the process as much as possible.
Sincerely,
~ `%~%G~nra~ivl
Jim Burnell
Environmental Protection Specialist
