Its purpose is to satisfy the requirements of Section 34-32-115(4)(d) CRS 1973 as amended, in lieu of two- party agreements signed by the third parties referred to in the enclosed instrument. Early in October I forwarded proposed agreements for this pur- pose to American Telephone & Telegraph, Sinclair Pipeline Com- pany, Whitney Irrigation Company, and B. H. Eaton Ditch Company. To date, the only response we have received has been from the district office of AT&T in Denver, and they inform me that author- ization for them to execute the agreement must come from California. I have received no response from any of the other parties. We will of course diligently pursue the matter of these agreements with the parties authorized to execute them, and following com- pletion, copies thereof will be submitted to your office for the La Poudre application file. In the meantime, it is my hope that this unilateral agreement will constitute sufficient assurance on the part of La Poudre that the statute regarding damages will be complied with.
