ctmFACF r.A O R' CON NT <br />• <br />I, e.Qwi~i ~_, ~i~~ ,certify that Powder Mountain.Ranch holds surface <br />rights on certain land on which Powderhom Coal Company (Powderhom) has made application <br />for Mining and Reclamation Permit No. C-81-041 with the Colorado Division of Minerals and <br />Geology to mine. Powder Mountain Ranch has granted Powderhorn right-of-ways for a road, a <br />diversion ditch, power lines and a substation on the following land: <br />Township 10 South, Range 98 West, 6PM, Mesa County Colorado: <br />Portion of the SEl/4SW]/4 Section 34 <br />Portion of the Wl/2 SWl/4 Section 35 <br />Township I I South, Range 98 West, 6PM, Mesa County Colorado: <br />Portion of Lots I, Z and 3 Section 1 <br />Portion of Lots I and 2 Section 2 <br />I have examined the current mining and reclamation plan prepared by Powderhorn and in <br />compliance with the Colorado Division of Minerals and Geology's Rule 2.05.5(1)(b), do hereby <br />• approve of the provisions of the plan relative to the above described land. Also, in accordance <br />with the Colorado Division of Minerals and Geology's Rule 4.03.2(1)(8), I do hereby request that <br />the portion of Light Use Road 1 which crosses the alcove described land and as shown on the <br />attached diagram be left in place subsequent to mining and reclamation operations. This road has <br />been used prior to and concurrent with Powderhorn's operation for general access to this and <br />adjacent land.
