Oehler, <br />I have received your letter of March 20,2002 with the request to address several <br />items needing clarification for the O'Dwyer Pit M-2000-017. <br />Exhibit C-mining plan. <br />a~~ 1. This operation will be used less than 180 days per year. <br />ok 2. The topsoil, overburden pile left on the site from a pass operation have been in <br />place for oven 20 years and have natural covet on them, of native grasses, and <br />there is more than enough to not need any other salvaging of top-sail with the <br />new operation. This is addressed in Exhibit C in the original permit <br />application. <br />v~`~. 3. The hauUranch road is addressed in Exhibit D in the original permit and will <br />the haul road will be included in the permit area but not the ranch road itself. <br />~4. The operation does meet the required water laws, again this is address in the <br />original permit, Exhibit C. <br />p(,ti 5. Our operation does appear to be in the area that was used before, I have no <br />way to be 100% sure that we are in the entire old area. This area was used <br />long before permits were required, and there has been several floods of the <br />Arikaree since the area was abandoned. We are trying to use the stockpiles of <br />top-soil and the material as a gauge to determine that we are in the old area. <br />Exhibit D- Reclamation Plan. <br />OS" 6. is addressed in the original permit application, the river bed will be allowed to <br />replenish itself wlth material during run off. <br />7. The present growth in the area is very little grass mostly catus and has been <br />grazed and feeder used to feed cattle.
