•
;~
DEPARTMENT OF THE ARMY
U.S. ARMY ENGINEER DISTRICT, SACRAMENTO
CORPS OF ENGINEERS
1J25 J STREET
REPLY TO SACRAMENTO, CALIFORNIA 9591A-2922
~TTEMl10M OF January 27, 1999
Regulatory Branch (199975039)
Mr. Thomas Gillis
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
Dear Mr. Gillis:

RF~FIVED
MAR U 3 1999

We are responding to your written request for comment on the
Notice of 112 Construction Materials Reclamaticr. Permit
Application Consideration for Grand Junction Pipe and Supply
Company, Delta Paving Gravel Pit Number M-98-105'. The project is
located adjacent to the Gunnison River within Sections 3 and 10,
Township 15 South, Range 95 West, Delta County, Colorado.
Based on a site inspection by Mr. Randy Snyder of this
office we have determined that jurisdictional waters of the U.S.,
including wetlands are located within the pit boundary. In
accordance with Section 404 of the Clean Water Act, a Department
of the Army permit is required for any discharge (including
mechanized land clearing) of dredged or fill material in waters
of the United States. Within the context of Section 404, "waters
of the United States" are defined as the territorial seas;
perennial and ephemeral streams; lakes, ponds, impoundments; and
wetlands. Federal law requires that any individual or entity
proposing to or discharge into waters of the United States obtain
a Department of the Army permit prior to commencing just work.
To aid the applicant, we have enclosed a list of wetland
consultants who routinely perform wetland delineations and are
familiar with the Section 404 permit process.
We have assigned number 199975039 to this project. Please
refer to this number if a Department of the Army permit is
required on this gravel pit. If you have any questions, please
write to Mr. Snyder or telephone (970) 243-1199, extension 14.
Sincerely,
,,~ ~
Randy Snyder
Project Manager
Ecologist
Enclosure
