The Pertnittee, H & H Stone Co., Inc. desires to caldud a muting operation lmown as H & H <br />Stone Quarry # 3, for the purpose of extracting stone. The PertniGee will nd mule any secardary commodities. <br />B. On May 14, 2001 the Mined Land Reclamation Board (the "Board") approved the Pertnittee's <br />appbcation for this permit, fixed the amount of the financial wartanty and directed that this permit be issued upon <br />the filurg with the Division of Minerals and Geology (the "Divisiar") of performance warranty and financial <br />warranty (or warranties) m the amount so fixed m form and substance approved by the Division. Said warranties <br />have been filed with the Division. <br />C. If the PemtiVee desires to extras materials other than those listed ur (A), a separate permit may <br />be required. <br />D. On May 14, 2001 the Board made the following findings: <br />1. The application far this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Ad forthe Extraction of ConsWdion Materials, C.RS. 34-32.5-101 d sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operator will nd adversely affect the stability of any significant. valuable, and <br />permanerrt man-made swdure located within two hundred feet of the Aflectsd Land, except where there is an <br />agreement between the Operator and the perscals having an urterest m the structure that damage to the structure is <br />to be compensated for by the Pemtittce; and; <br />
