;. <br />declining water levels, the Applicant should not be required to take any <br />further action and shall be able to resume mining operations. If the <br />investigation concludes that the Applicant is responsible for declining <br />water levels, the mitigation plan outlined in the attached document will go <br />into effect. However, if it is determined that causes are not due solely to <br />mining operations, the burden of mitigation should be shared <br />proportionate to the share of cause, as determined by the study. An <br />independent study that does not show cause of the groundwater drop will <br />not be accepted. Please note that the Applicant is working directly with <br />interested parties to reach an agreement that serves all parties involved. <br />If reached, this agreement could supersede the measures outlined above. <br />Please indicate the specifics regarding the groundwater monitoring plan <br />including, the number and location of monitoring wells and the number <br />and location of private wells to be incorporated in the plan, the frequency <br />of measurement, and the reporting parameters regarding the groundwater <br />data." Please see the attached mitigation plan with maps for these <br />details. <br />The Applicant will commit to 5 quarters of monitoring data prior to <br />installation of the slurry wall, as requested by the Division. <br />3. The Division states that `9t is necessary for the Division to receive a letter <br />from the U. S. Fish and Wildlife Service indicating that the mining plan has <br />clearance through them prior to approval of the permit." Due to the <br />backlog of work for wildlife consultants we have contacted, clearance <br />from the U.S. Fish and Wildlife Service may not be possible for another <br />30-60 days. We respectfully request that the current plan be approved as <br />proposed, with the condition that the U.S. Fish and Wildlife Service's <br />opinion be submitted to the Division for review prior to commencement of <br />operations. If Fish and Wildlife's opinion creates a need for change in <br />Mining and Reclamation Plans, the Applicant will submit a Technical <br />Revision or Amendment. <br />For the reclamation cost estimate, the Division requested that the <br />Applicant "list all structures that will be constructed on site including their <br />composite, dimensions and method of reclamation." No permanent <br />structures will be constructed on site, All equipment and other structures <br />such as a temporary office and scale house, will be portable in nature. <br />However, the existing structures, four wood frame and one corrugated <br />steel, will be removed. The four wood structures include one house, one <br />barn, one maintenance building, and one shed. Their dimensions are as <br />follows: 40 x 20ft.; 32 x 42 ft.; 28 x 43 ft; 11 x 7 ft. These structures <br />range in height from 15-30 feet. The silo is 10 ft. in diameter and <br />approximately 50 ft high. <br />5. We await the Division's review of the submitted Slope Stability Analysis. <br />I hope that the attachment and the above discussions pertaining to your <br />adequacy concerns sufficiently address the Division's questions regarding <br />
