Also, the regional groundwater table will not be elevated <br />enough to cause any adverse impacts to basements or septic tank leach fields in the surrounding area. <br />Further, the applicant has committed to a groundwater monitoring program that will ensure collection of <br />groundwater levels prior to slurry wall completion, following slurry wall installation, and throughout the <br />mining phase of the operation to detect any significant change in groundwater levels due to the applicant's <br />mining activities. <br />4. Has the applicant provided an adequate description of the general effect during and after the proposed <br />mining operation on the existing wildlife of the area, including temporary loss of habitat and the general <br />effect on the wildlife from increased human activity? (Rule 6.4.8) <br />DMG Response - Hall-Irwin has provided a wildlife assessment for [he site which verifies the absence of <br />any candidate or listed threatened and endangered species, and the absence of any significant natural <br />vegetative communities. The adjacent riparian corridor between the project site and the South Platte River <br />will remain undisturbed and will continue [o be used by existing wildlife species. The mining plan has <br />been devised to minimize impacts to wildlife as mining will occur in phases and reclamation will be done <br />concurrently to limit temporary disturbance [o existing species. Mining and reclamation of the site, by <br />creating 83.6 acres of water surface and planting of additional trees and shrubs, will result in a more diverse <br />and favorable wildlife habitat than currently exists. <br />ISSUES THE DIVISION BELIEVES ARE NOT WITHIN THE JURISDICTION OF THE <br />DIVISION AND BOARD <br />1. Economic impacts. <br />Based on our review of the permit application and all supporting documentation, the Division recommends <br />conditional approval of [he Regular 112 Application, with a financial warranty requirement of $900,400. <br />The condition of approval is as follows: <br />"A reportable spill is a spill of any toxic or hazardous substance (including spills of petroleum products) <br />within the mined land permit area reportable to anv Division of the Colorado Department of Public Health <br />and the Environment, the National Response Center, the Colorado Emergencv Planning Commission, any <br />local Emergency Planning Commission, local Emergencv Planning Committee, or the State Oil Inspector. <br />The Mine Operator shall notify the Division of Minerals and Geoloev (DMG) of a reportable spill within <br />the mined landpemtit area using the same timeframe requued by the permit, license, notice. statute, mle or <br />regulation governing [he reporting of [he spill to the other appropriate agency.
