Rationale for Recommendation of Conditional Approval, Over Objections <br />Regular 112 Construction Materials New Application <br />Hall-Irwin Corporation <br />Nissen Farm Resource, File M-2003-001 <br />Introduction <br />The Hall-Irwin Corporation Regular 112 Application for 134.21 acres was originally found complete and <br />considered filed with the Division on January 2, 2003. Due to the applicant's request, review of the <br />application was suspended until May 20, 2003 when a revised application was filed. Due to objections <br />received during the public comment period apre-Hearing Conference was held on July 25, 2003. On <br />August 12, 2003 [he Division issued a recommendation for approval of the application, over objections. <br />The Nissen Farm Resource site is located several miles east of Greeley in Weld County, Colorado. The <br />proposed permit area is located in part of the south half of Section 12, TSN, R65W, 6'" P.M. A total of <br />89 acres will be excavated throughout the life of the operation. Of this total, there will be a maximum <br />disturbance of 23.1 acres at any one time (excluding the processing area and perimeter screening berms). <br />A slurry wall will be installed surrounding the 89 acres to be excavated. The site will then be dewatered <br />and dry mined using conventional mining equipment. The depth of excavation is expected [o be <br />approximately 41 feet below ground surface down to bedrock. Alluvial groundwater is reported to be <br />approximately 4 to 8 feet below the ground surface. The applicant has provided a hydrologic assessment <br />to predict possible offsite groundwater impacts and has committed to a groundwater monitoring program <br />throughout the life of the operation to determine if and when a significant change in groundwater level has <br />occurred. In addition, the applicant has committed to implementing mitigation measures if it is determined <br />that an adverse hydrologic impact has been caused by their mining activities. The site will be reclaimed to <br />developed water resources and will include three (3) water storage vessels with 83.6 acres of water surface. <br />Surrounding areas will be topsoiled and revegetated with a grass mix. Tree and shmb plantings will also be <br />established as part of the revegetation process. The Division has calculated a total reclamation cost of <br />$900,400, assuming a 20% slurry wall installation cost. Final engineering designs and QaCc procedures <br />for the slurry wall installation will be submitted to the Division as a technical revision prior to constmction <br />of the slurry wall. <br />L OBJECTIONS: <br />The Division received objections from the following individuals during the public comment period. <br />Obiector Date Received <br />Richazd C.
