.• <br />NOW THEREFORE, Pursuant to the authority set forth in the Colorado <br />Open Mining Land Reclamation Act, the Land Reclamation Board of the State of <br />Colorado has determined that the following land stabilization and reclamation <br />procedures will be followed in the mining operation of Corn in Section 6, <br />Township 1 South, Range 1 West, Mesa County, Colorado, and Corn hereby agrees <br />to faithfully perform the land stabilization and reclamation work required <br />herein. <br />1. Corn will monitor and control fugitive dust to keep same in <br />compliance with the dust emission standards set by the Colorado Air Pollution <br />Control Commission. <br />2. Blasting will be conducted during daylight hours only, and in <br />a manner to alleviate or curtail shock and concussion nuisance by controlling <br />the size of the blast. <br />3. Daily operations will not begin before 6:00 a. m. nor extend <br />past 10:00 p.m. <br />4. Plan and agreement will be updated annually so that new <br />techniques can be utilized as they are produced or found. <br />5. Corn will furnish the Land Reclamation Board a performance <br />bond in the amount of Fifteen Thousand Seven Hundred Fifty Dollars ($15,750.00) <br />to insure that the work required herein will be accomplished. <br />6. Wherever possible Corn will stockpile and retain topsoil on <br />the property covered by this permit for future use on said property. <br />7. Unless development plans are scheduled for a particular area <br />within a period of three (3) years after cessation of mining operations, <br />Corn will grade and stabilize any surface area disturbed by this operation <br />and revegetate the area, following the best information available from <br />qualified organizations or persons. <br />8. Corn will maintain and stabilize finished slopes to a ratio no <br />steeper than two (2) horizontal to one (1) vertical. (The above can revert <br />to a less steeper slope to conform to local zoning regulations). <br />-2- <br />
