M-2004-067 f <br />THIS MATTER came before the Mined Land Reclamation Board ("Boazd") on <br />December 14, 2005, in Denver, Colorado for a hearing to consider the request of Clear <br />Creek District Water Providers, LLC ("Applicant") for a Section 112 Reclamation Permit. <br />The file number in this matter is M-2004-067. Christopher Hayes appeared on behalf of the <br />Applicant. Harvey Curtis, Patricia Madsen, Hillary Mogue Graham, Corey Hoffrnan and <br />David Kueter appeared on behalf of party objector City of Black Hawk. Kim Seter and <br />Staci Usagani appeared on behalf of party objector Black Hawk/Central City Sanitation <br />District. Brad Hill appeared on behalf of party objector Estella Leopold. James Petrock <br />appeared on behalfof Gilpin County. Lisa Mayers appeared on behalf of the Black Hawk <br />Gaming Association and the Silver Dollar Metropolitan District. Steve Brown appeared on <br />behalf of the Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following Findings of Fact, Conclusions of <br />Law and Order: <br />1. The Applicant intends to extract aggregate from a quarry to be developed on a 526.70- <br />acre site located in Section 6, Township 3 South, Range 72 West, 6`h Prime Meridian, <br />Gilpin County, Colorado. Within the permit boundaries, the Applicant intends to develop <br />39.28 acres of affected lands, of which 17.6 acres will be in quany production. The site <br />MMRR Boazd Order, M-2004-067 <br />
