<br />,~ ...~ <br />Mr. Robert E. Wright -2- June 21, 1984 <br />Finally, I reviewed your planned republication, and it appears to be correct <br />with respect to the legal description, this time. Please mail me a copy of <br />the publisher's affidavit as soon as it is available. I will need this proof <br />of publication before our Board can consider the application. Since the <br />permit area lies entirely within Mr. Schmalz's land, I agree with your <br />judgment that no further notification letters need be sent. <br />I plan to present the various matters of protest that I have received in this <br />matter to the Board during the scheduled June 27-28, 1984 meeting. Those that <br />I feel are County matters, and thus outside of our Board's jurisdiction, I <br />will identify as such. Those matters that are within our Board's jurisdiction <br />(as mentioned above) have, in my professional opinion, been adequately <br />resolved, and I will so inform the Board. <br />Therefore, at this juncture, I will plan to recommend approval of the permit <br />application (with the modifications as submitted by you) with the financial <br />warranty set at X5,000.00 and with a stipulation concerning wildlife, if <br />necessary. Although County zoning approval has already been verified to me, <br />would appreciate your submission of written proof of Gunnison County's <br />reaffirmation of the approval (which presumably occurred on June 19, 1984). <br />You have already been notified of the Board's consideration, at this same <br />June 27-28, 1984 meeting, of your client's possible violation on this site of <br />mining without a permit.
