Wands <br />THIS MINING LEASE, Nade in duplicate and entered into this 16th day <br />of November 1489, by and between the State of Colorado, acting through <br />its STATE UOARU, OF LAND CONMISSIONEi<S, hereinafter referred to as Lessor, and <br />_ bFC Ceramics. Inc. <br />515 South Ninth Street, Canon City. PATENTS <br />400.00 N/2NE/4; SE/4NE/4; SW/4NW/4; 36-18S-67W 7367 (A11) <br />W/2SW/4; SE/4SW/4; S/2SE/4; 6244 (SE/4) <br />NE/4S£/4 <br />Access to this lease will be restricted to the period from November 1 through <br />the following January 31 or a similar three-month period to be mutually agreed <br />upon by the state or its mineral lessee and the officer of the Government <br />having jurisdiction over the premises. <br />FUND: School <br />containing 400.00 acres, more or less, together with the right to use as muct~ <br />of the surface as may be reasonably required in the exercise of the right to <br />mine, including strip mi:,ing, in situ solution mining, and heap leaching; and <br />ttie right to reasonable ingress and egress; the right to construct buildings, <br />make excavations, stockpiles, dumps, drains, roads, railroads, powerlines, <br />pipelines, and other improvements as may be reasonably necessary in the mining <br />anG removal of said minerals; subject, however, to all existing easements and <br />rights-of-way of third parties, and the rights of surface lessees and surface <br />patentees, and further subject to the terms, conditions and agreements set out <br />in this lease. The above-mentioned rights may be exercised in connection with <br />mining on other or adjacent lands only when mining on such lands is carried on <br />in conjunction with the actual mining on the land herein leased. The above <br />right to use state lands without mining on the lands herein leased will beat <br />the discreti.~n of Lessor. <br />
