I~ <br />2.3.3 Water Requirements During Mining and Reclamation <br />Water is required for the control of fugitive dust along the haul road. Water <br />requirements for fugitive dust control are approximately 1500 gallons per day or <br />540,000 gallons per year. There will be periods when no water will be required; <br />thereby, reducing this requirement by an indeterminate volume. <br />2.3.3.1 Water Rights <br />All water used in the mining and pollution control operations will be obtained from <br />u <br />the Colorado River near Loma. The Operator has first and prior right to 10 cfs of water <br />from the Mack Pumping Pipeline as set forth in C.A. No. 13368, Mesa County District <br />Court by decree, April 13, 1972, and as modified May 29, 1974, see Appendix C. <br />2.3.4 Sedimentation Controls <br />Surtace runoff from the areas disturbed by the waste rock disposal area will be <br />routed to sediment control ponds or other approved structures. The ponds and ditches <br />have or will be designed in accordance with applicable criteria. Discharge of water will <br />be covered by an NPDES permit prior to construction of any ponds. <br />Mine Bench Area <br />A rock check dam and silt fence provide sedimentation control for the Mine <br />Bench Area.
