BOa~ <br />Department of Natural Resources <br />1313 Sherman Street, Room 423 Telephone: 839-3367 <br />Denver, Colorado 80203 <br />DEVELOP~VT a.`]D E:tTRACTIOY ~fI`lI:IG PER_`SIT <br />T'dI5 PER.`fIT is issued this 25th day of November, 1980 by the ?tined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />Iv I T :] E S S E T H <br />wi3EREA5, SAGUACHE COUNTY desires to conduct a(n) open airi.^.g <br />operation, known as Airport Pit for the purpose of extract:iag open <br />mined sand b gravel; and , <br />WHEREAS, on December 19 19 77, SAGUACHE COUNTY "FILED" an <br />apnlication,a reclamation plan and map, and the required fee, as requirec. by Inca; and <br />1vTiEREaS, on October 23 19 80, the :tined Lard Reclamation Board. approved <br />SAGUACHE COUNTY application and set bond; and <br />WHER:AS, on November 2 19 gp, the :41ned Land Reclamation Board accepted <br />surety submitted by SAGUACHE COUNTY and such date shall be considered the <br />- date of Issuance of the permit and Che anniversary dace for all ocher purposes; and <br />1~iHERE.aS, the `tined Land Reclamation 3oard has made a Finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />`fined Land Reclamation act and all applicable local, state and <br />Federal laws; and, <br />2) the operation wi'_1 not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, e:ccenc where there <br />is an agreement beraeen the operator and the persons having an <br />interest is the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried ou. <br />in conformance with the requirements of C.R.S. 1913, 34-32-116, .:s <br />amended (1916 Sess. Laws :?.3. 1065); and <br />:+T'.EREaS, for the purposes of issuing this permit, the operator has n:_de a <br />satisfactory showing to the Board that he :aili employ during and aft=_r _., <br />open mining operations procedures reasonably des'_gned to mini~i~e <br />as much as practicable the disruption from the open mining operations <br />and will provide for the rehabilitation of the affected land through the rehabilitation <br />of plant cover, soil stability, .rater resources, and ocher aeasures appropriate to toe <br />subsequent heneficial use of suck mined and reclaimed lands; and that in the event <br />of the failure of his proposed reclamation plan, he will take whatever meacsures wh'_ch <br />nay be necessar;+ in order co assure the success of reclamation of the lands affected <br />b;+ his open mining operations; and, <br />'.~l1EREdS, for the purposes of issuing this permit, a coo;+ of [he aoplf.cation <br />approved Sy the `fined Land Reclamation 3oard of the State of Colorado is z:ttached <br />to this permit and thereby becoaes a part of the terms hereof. <br />\0'd, TSEREFORE, pursuant to the authority sec forth is the Colorado `fined <br />Land Reclamation act, article 32 of Tit'_e 34, C.R.S. 1973, as amended, (lSi6 <br />Sess. Laws H.3. 1055) the ?'tined Land Reclamation Board of the State of Colorado <br />hereby issues a life of the sine permit to SAGUACHE COUNTY _: engage <br />in open mining for the purncse of extracting open <br />mined sand b gravel on the fo1'_owing parce'_ of grcund, to wit: <br />NE 1/4 NW 1/4, Section 2, T. 45N, R. 7E, NMPM, Saguache Countl~, <br />Colorado. <br /> <br />
