<br /> <br /> <br />February 9, 1982 <br />Mr. Charles Silengo <br />2684 Carol Place <br />Grand Junction, Colorado 81501 <br />Dear Mr. Silengo: <br />I would like to take this opportunity to informally advise you of planned <br />construction activities for the southwestern corner of section 31. In <br />order to treat the waste water generated at the Number 5 mine, a waste <br />water treatment facility will be built at the site. The majority of the <br />facility will be located on Empire's property with a small portion ex- <br />tending into section 31. It is anticipated that construction will commence <br />in the beginning of March and completed by the end of the month. The <br />treatment facility will be reviewed and approved by a host of regulatory <br />agencies prior to construction. <br />In a separate matter, per the notice requirements for underground mining <br />contained in the "Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining", Empire advises you of its intent to mine under <br />certain parcels of land of which you are the surface owner. The attached <br />map identifies the areas to be mined, and the following table gives the <br />mining sequence: <br />Location Year <br />10 North 1982 <br />11 North 1982-1983 <br />6 East (part of) 1982 <br />7 East (part of) 1983 <br />8 East (part of) 1984 <br />9 East (part of) 1985 <br /> <br />Full extraction mining is planned for each of these areas. The areas will <br />be subsided in accordance with the schedule outlined.above.
