Please be advised that the road going up Apache Canyon that crosses Basin Resourccs'
North Veut shaft located at 37° 08.426N / 104° S6J60W and their South Vent shaft
located at 37° 07.668N / 104° 57.877W is used by XTO Energy Ina (XTO) for its oil and
gas operations. XTO owns and operates the following four (4) wells that arc accessed by
the aforementioned road: Apache Canyon 03-0I, New Elk 35-13, Ncw Elk 35-I 1 and
New Elk 35-02. XTO recognizes and accepts that it is responsible for maintenance and
repair of said road.
