it <br />:i ~ <br />• <br /> <br />Letter of Agreement <br />between the <br />Colorado Mined Land Reclamation Division <br />and <br />Pueblo Coal, Inc. <br />I. Introduction <br />Pueblo Coal lnc. (the operator) and the Colorado Division of (dined Land <br />Reclamation (the Division) hereby enter into the following agreement in regard <br />to continuation of the review time period for renewal of Permit C-82-054 for <br />the Carbon Junction (dine beyond the 180 day timeframe specified in Section <br />119(2) of the Colorado Surface Coal Mining Reclamation Act (Act). Violation <br />of th> timetables or conditions set forth below will constitute sufficient <br />reason for the Division to ao forward with a recommendation to deny the <br />renewal application or the applicant to petition the Mined Land Reclamation <br />Board (the Board) for a hearing on the issues. <br />II. :onditions <br />4. By June 1, 1990,the operator will submit to the Division an <br />acceptable replacement bond or rider to the current bond, <br />increasing the reclamation bond amount to 51,125,300.00 or such <br />amount as agreed to by the parties to ensure reclamation of the <br />site. <br />3. The operator will continue to perform maintenance and monitoring at <br />the Carbon Junction tdine as required by the permit and regulations. <br />:. By December 11, 1989, the operator will submit to the Division <br />Annual Hydrologic Reports for the 1986, 1987, 1988 and 1989 water <br />years. The reports will include all reduced and tabulated <br />hydrologic data collected during each year, as well as an <br />interpretation of the data and a discussion of any trends or <br />impacts to the hydrologic system. In addition, an updated probable <br />hydrologic consequences evaluation based on observations made and <br />data collected since permit issuance will be submitted. <br />). By June 1, 1990 the operator will submit to the Division all <br />information necessary for the Division to render a decision on the <br />permit renewal. <br />_. The operator will not conduct any surface coal mining operations or <br />create additional surface disturbance with the exception of those <br />operations required for routine monitoring and maintenance to <br />maintain the site in compliance. This condition will remain in <br />effect until a decision on the permit renewal is rendered by the <br />Division. <br />-1- <br />
