This section <br />of the statute states that "Applications for permits under this section shall <br />be processed and final action taken thereon within 30 days of the filing there- <br />of. If action upon the application is not completed within the 30-day period <br />specified in this subsection (7), the permit shall be considered to be appro- <br />ved and shall be promptly issued upon presentation by the applicant of surety <br />in the amount provided in subsection (3) of this section". Since the appli- <br />cations were apparent]y filed in October of 1977, and since we are submitting <br />herewith a written guarantee, in lieu of surety, stating that the affected <br />lands will be reclaimed in accordance with the terms of the permit and section <br />34-32-116, we believe the permits for these applications must now be issued. <br />In order to assist you in obtaining or locating the information you requested <br />in your letter of September 4, 1980, the following information is provided: <br />Legal Description of all 6 pits, Exhibit A <br />Please amend the applications by adding an "N" after Township and a "bl" <br />after Range. (Mark Haffner had previously indicated that handwritten addi- <br />tions as requested herein would be sufficient} <br />2. Mining Plan for all 6 pits, Exhibit B <br />a. No topsoil has been remove rom the affected areas, nor is any expected <br />to be removed from the affected areas, since the gravel which is being <br />removed is present on the top layer of ground. <br />
