On December 14 1984, the Mined Land Reclamatio Board of <br />the Colorado epartment o Natural Resources (the "State") granted o <br />James A. Wiley address <br />66124 Junioer Ct. Montrose. CO 81401 _ _ ("Permittee") pe it number <br />M-84-108(the "Permit") pursuant to which Permittee has been conduc ing a <br />mining and reclamation operation in the County of Montrose State of <br />Colorado. <br />B. Permittee wishes to assign the permit to <br />address P.O. Box 1287 Montrose CO 81401 <br />as Successor Operator ("Successor") <br />an uccessor wis es to become uccessor ermittee under the permit. <br />C. Successor understands that the reclamation plan (the "Plan") <br />required by the permit and by applicable State laws and regulations as not <br />been completed and is willing to assume full responsibility for the ompletion <br />of the Plan. <br />II. <br />AGREEMENTS <br />Permittee and Successor hereby agree, for their own benefit an for the <br />benefit of the State, such agreements to be effective ipso facto upo the <br />approval by the State of the transfer of the Permit from Permittee t <br />Successor, as follows: <br />1. Successor has inspected the mining and reclamation operati ns to its <br />entire satisfaction and is fully aware of the condition thereof. Su cessor <br />understands and accepts all of the conditions of the Permit. <br />2. Successor will complete the reclamation plan, and hereby a sumes <br />liability for completing such plan as to all areas heretofore distur ed, as <br />well as to all areas hereafter disturbed.
