Pursuant to Rule 1.4.5(31, DMG decision date has been set at 1/11/99. DMG
review of the application has identified the following adequacy issues. Please be advised that the
Whitewater Pit application may be deemed inadequate, and may be denied on 1/11/99 unless the
following adequacy review items are addressed to the satisfaction of DMG.
ADEQUACY ISSUES
Proof of Publication Pursuant to Rule 1.6.2(1)(8), please submit the proof of publication for 4 weeks,
as required by Rule 1.6.2(11(d) and 1.6.5.
Proof of Notice Pursuant to Rule 1.6.2(1)(87, please submit the proof of notice (copy of certified
mail return receipt--green card) required by Rule 1.6.2(1)(a), for the Board of County Commissioners
and Board of Supervisors for the soil conservation district. Pursuant to Rule 1.6.2(1)(87, please
submit proof of notice to owners of record as required by Rule 1.6.2(1)(e)(q & (ii).
Exhibit D--Mine Plan The text portion of the Mine Plan includes only 2 pages. The first page ends
with a complete sentence which appears to close a paragraph addressing the life of the mining
operation. However, the first sentence of the second page is an incomplete sentence which appears
to have started on a previous page. Please clarify whether the error on the second page is simply a
"cut & paste" error from word processing, or if a page is missing from the Mine Plan. Please submit
the missing page, or submit a corrected page 2 as appropriate.
Please contact me at the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO
81301, phone (970) 247-5469, if you have any questions.
Sincerely,
Wallace H. Erickson
Environmental Protection Specialist
