Box 60340 <br />Grand Junction, Colorado 81506 <br />RE: CAM-Colorado LLC <br />Proposed Redcliff Mine <br />Alluvial Valley Floor Informal Opinion <br />Dear Mr. Stover: <br />Your letter of April 28, 2006 requested an informal Board opinion as to whether or not <br />the area of land to be affected by the proposed Redcliff Mine is in, adjacent to, or under <br />an alluvial valley floor. The request was made in accordance with Rule 2.06.8(3)(a), <br />which states: <br />Any person who proposes to engage in surface coal mining operations, may, prior <br />to making an application for a permit, request in writing that the Board give an <br />informal opinion on whether or not the area of the land to be affected by such <br />proposed operations is in, adjacent to, or under an alluvial valley floor. The <br />Board's opinion shall be based upon sound scientific data in the possession of the <br />Division, Board, or other State agencies at the time of the request, shall be in <br />writing, and shall be advisory in nature. <br />Although the rule indicates that such informal opinions are to be provided by the Board, <br />in the interest of expedience and practicality, our established practice is for the Division <br />to provide an initial response. If the applicant desires an informal Board opinion <br />following receipt of the Division's informal opinion, such request can still be pursued. <br />As such, the Division has reviewed the information submitted with your request, <br />including map Figures 1 and 2, which delineate various prospective mine facilities within <br />an 1890 acre "Resource Survey Boundary".
