• Rule 1.03 <br />Figure 2.03-1, Surface Ownership and Figure 2.03-2, Coal Ownership, show surface and ttuneral <br />ownership within the mine permit boundary and for contiguous lands. <br />(8) The MSHA I.D. number for HGCC is 05-03138. <br />2.03.5 Compliance Information <br />Neither HGCC, its affiliates, any subsidiaries or persons controlled by or under common control <br />with HGCC has had a Federal or State mining permit for surface coal mining operations suspended <br />or revoked in the last five years prior to the date of submission of this application or forfeited a <br />mining bond or similar security deposited in lieu of bond. <br />HGCC has not received any notices of violation (NOVs) for the four yeazs prior to this <br />application date. For informational purposes only, a complete listing of all NOVs issued under <br />Permit C-80-003 (H-G Mine) is presented below. <br />NOV C-90-042; Issued 9/28/90 by Colorado Mined Land Reclamation Division <br />(NERD). Failure to clearly mark the perimeter of the permit area boundaries at the <br />railroad loadout. MLRD subsequently vacated the NOV on 12/10/90. <br />2. NOV C-90-045; Issued 10/12/90 by the MLRD. Resulted from OSM TDN X-90-02- <br />107-13 for failure to maintain a culvert as designed under an access road. The NOV <br />was terminated 11/20/90. Pursuant to a ~k/91 Settlement Agreement, HGCC paid <br />a $500.00 civil penalty on 3/18/91. <br />Regular DMG inspections at the Hayden Gulch Mine since the last permit renewal on January 4, <br />1992 have not resulted in violations, citations, or other enforcement actions. <br />2.03.6 Right of Entry and Operation Information <br />Copies of coal lease and surface ownership agreement documents granting HGCC rights to enter <br />and conduct surface coal mining operations in the permit area are contained in Appendix A, Volume <br />II.
