Colorado 81003 <br />[]ivislon of iwmeral. n ~,~~,",~, <br />RE: CONDITION NO. 17 OF SPECIAL USE PERIvfIT NO. 97-09 <br />Dear Buck <br />Upon your request, we have reviewed Condition No. 17 of Special Use Permit No. 97-09, which <br />states: <br />Nonvithstnnding the regulations administered bi- the State ojColorado Mined <br />Land Reclamation Division, daring reclamation ojthe disturbed areas, an <br />eighteen inch (l8') high berm will be established to prevent erosion. <br />Staff's research shows this condition was inadvertentl}' carried over from another review- and is <br />unnecessary to this special use permit. Therefore, Condition No. 17 is removed from Special <br />Use Permit No. 97-09, effectively immediately. <br />Record of this action will be presented to the Pueblo Counry Planning Commission January 27. <br />] 998 as part of the Director's Report.
