Mined Reclamation recommendations:
It's the DOW opinion that the documented reclamation plans are adequate for this site.
~ DOW has recently had the opportunity to meet with the operators of the mine to
resolve the impacts on elk and to allow for a change in "times of operation" as listed
previously in the prior mining permit. The previous permit did not allow for mining
from Dec. 1 to April 1 in order to minimize the disturbance on wintering elk. The
operators feel they need the opportunity and flexibility to mine gravel during the
winter months and have cooperatively consented to provide mitigating measures for
elk use, The owners have traditionally worked with the DOW and have provided
grazing-forage for elk over the years on property owned by them. The owners have
agreed to continue this practice as well as the following concessions. On all
lands presently owned by the Wrights:
1. They will not submit any fence damage claim caused by elk as specified by law,
Title 33 C.R.S. for a "specified fence" unless the damages exceed $350.
2. The Wrights agree to leave a reasonable amount of forage to graze up to 194
AUM's for elk per year.(50 head/month 3.1 elk equals 1 AUM). This includes all
property presently owned or leased by the Wrights.
3. The owners agree to instruct personnel and to take precautionary steps to
minimize harrassment on elk.
4. The owners agree to continue to allow a "reasonable number" of hunters, during
established seasons, to hunt elk on their property.
