Will the operation avoid unauthorized release of pollutants to groundwater and minimize
disturbances to groundwater quality, specifically with regards to objectors' water supply wells?
d. Will the operation avoid unauthorized release of pollutants to the surface drainage system and
minimize disturbances to surface water quality, including during 50- oc 100-yeaz flood events,
specifically with regazds to petroleum products, dust control chemicals, and sedimentation?
e. Will the operation minimize disturbances to groundwater well quantity?
f. Will the operation adversely affect Bald Eagles or Golden Eagles nesting within one mile of the
site?
g. Will the operation minimize disturbances to the hydrologic balance specifically with regazds to
possible "pit capture" during flood events?
8. With regazds to the issues presented for review, the Boazd makes the following findings:
a. The application was complete and accurate.
b. The operation and reclamation plan will minimize disturbances to the hydrologic balance and to
the quality and quantity of water in groundwater and surface water systems.
c. The operation will not adversely impact Bald Eagles or Golden Eagles nesting within one mile
of the site.
d. The applicant's irrigation and rechazge plan for the cottonwood area along the Yampa river will
minimize adverse impacts to the cottonwoods from changes in the hydrologic balance.
10. The Boazd finds no basis in the record to deny the application or add conditions to the permit pursuant
to Section 34-32.5-115(4), C.R.S.
ORDER
Based on the above findings of fact and conclusions of law, the Boazd orders that the reclamation permit applied
for in File No. ~v1-2001-023 is hereby GRAN'T'ED..
~~--~~~
Dated this°"' day of~, 2001
MINED LAND RECLAMATION BOARD:
Michael B.
