RESPONSE: <br />• This permit application does not propose to conduct surface mining <br />activities or conduct or locate surface operations or facilities <br />within 300 feet of an occupied dwelling. Therefore, the requirements <br />of this subsection are not applicable. <br />Rule 2.03.8 - Permit Term Information <br />(1) Each application for surface mining activities shall state the <br />anticipated or actual starting and termination date of each phase of the <br />surface mining activities and the anticipated number of acres of land to be <br />affected for each phase of mining and over the total life of the permit. <br />2) Each application for underground mining .activiites shall state <br />the anticipated or actual starting date and termination date of each phase <br />of the underground mining activities and the anticipated number of acres of <br />• surface lands to be affected, and the horizontal and vertical extent of <br />proposed underground mine workings, for each phase of mining and over the <br />total life of the permit. <br />(3) If the applicant proposes to conduct the surface or underground <br />mining activities in excess of 5 years, the application shall contain the <br />information needed for the showing required under 2.01.5. <br />RESPONSE: <br />No coal will be mined under this permit application, only processing, <br />handling and loading of coal will occur. Sufficient information for a <br />five-year permit has been included in this application. Future <br />activities incidental thereto will be the subject of future permits. <br />Coal haulage to the Fish Creek Tipple was initiated on November 4, <br />1983. No new acreage is anticipated to be affected with this permit <br />application. All of the area to be utilized for the Fish Creek Tipple <br />and haulroad has been previously affected under Permit 76-16. <br />n <br />2.03-29 <br />
