(2) Where the private mineral estate to be mined has been severed <br />from the private surface estate (in circumstances involving the surface <br />mining of coal or where underground mining activities concurrently involve <br />the surface mining of coal) the application shall also provide for lands to <br />be affected within the permit area: <br />(a) A cop.y of the written consent of the surface owner to the <br />extraction of coal by surface mining methods; or <br />(b) A copy of the document of conveyance that expressly grants <br />or reserves the right to extract the coal by surface mining methods; or <br />(c) If the conveyance does not expressly grant the right to <br />extract the coal by surface mining methods, documentation that under the <br />applicable State Taw, the applicant has the Tegal authority to extract the <br />coal by these methods. <br />• RESPONSE: <br />The extraction of coal by surface or underground mining methods is not <br />proposed in this permit application. Furthermore, betty Minerals <br />Marketing, Inc., an affiliate of TCC, is the surface owner of all <br />lands within the proposed permit area. Consequently, the consent of <br />surface owners is not necessary and the requirements of this section <br />are not applicable. <br />(3) Nothing in 2.03 shall be construed as vesting in the Division or <br />board the jurisdiction to adjudicate property right disputes. <br />RESPONSE: <br />Twentymile Coal Company, with this permit application, does not <br />construe this submitted material as vesting in the Division or Board <br />the jurisdiction to adjudicate property right disputes. <br />n <br />U <br />2.03-27 <br />
