1 <br />Rule 2.03.6 - Right of Entry and Operation Information <br />(1) Each application shall contain a description of the documents <br />upon which the applicant bases his or her legal right to enter and begin <br />surface coal mining operations in the permit area, and whether that right <br />is the subject of pending litigation. The description shall identify those <br />documents by type and date of execution, identify the specific lands to <br />which the document pertains, and explain the legal rights claimed by the <br />applicant. <br />RESPONSE: <br />Colorado Yampa Leasing Company (formerly Colorado Yampa Coal Company, <br />formerly Energy Fuels Corporation) adopted a Plan of Partial <br />Liquidation on August 30, 1982, pursuant to which its coal interests <br />and other real property interests were transferred to Getty Coal <br />Company, which later transferred such interests to Getty Minerals <br />Marketing, Inc. <br />• Twentymile Coal Company has contracted with Getty Minerals Mark ting, <br />Inc. to operate the underground coal operations. Mining equipme t and <br />facilities for the underground operations are owned by Getty Coal <br />Leasing Company and Teased to Getty Minerals Marketing, Inc. The <br />surface support facilities and structures incidental to the <br />underground activities are owned by Colorado Yampa Leasing Company and <br />leased to Getty Minerals Marketing, Inc. <br />The following documents, numbered 1-6 vest in Twentymile Coal Company <br />the Rights shown in and to the surface estate. <br />(1) CERTIFICATION OF NAME CHANGE <br />Dated December 31, 1981, Secretary of State of Colorado <br />certification of name change of Energy Fuels Corporation to <br />Colorado Yampa Coal Company. Reference in the description of <br />documents below to Energy Fuels Corporation is to the entity <br />• which changed its name to Colorado Yampa Coal Company and then to <br />2.03-25 <br />
