Simpson, P.E. <br />State Engineer <br />This letter is in response to the above referenced application for a reclamation permit for <br />the Allen Pit, Permit No. M-2005-080, filed by the Allen Drilling and Excavating Company. This <br />letter also is in response to the letter dated May 30, 2006 from Ms. Sheela Stack of Harvey <br />Curtis & Associates, concerning the proposed Allen Pit. <br />This office reviewed and commented on the proposed mining plan for the Allen Pit by <br />letter dated February 8, 2006 (copy enclosed). Information in the file of the Division of Minerals <br />and Geology ("DMG") for the Allen Pit indicates that the Allen Pit is proposed to be excavated to <br />a depth of approximately 10 feet and the excavation is not expected to expose ground water. <br />Based on this information, our comment letter of February 8, 2006 indicated that the mining <br />operation was not expected to expose groundwater and therefore, a substitute water supply <br />plan would not be required. <br />Based on the comments in the May 30, 2006 letter from Ms. Stack, this office reviewed <br />the well construction reports of two existing monitoring holes (monitoring hole notice nos. <br />46101-MH and 46102-MH) that are reported to be drilled within the reclamation permit <br />boundary of the Allen Pit. Based on the information reported in those files, the ground water <br />level varies between 16 feet to 21 feet below surface at the pit site. Accordingly, at a maximum <br />excavation depth of 10 feet, it does not appear the proposed mining operation would expose <br />ground water to the atmosphere. However, in the event that ground water is exposed to the <br />atmosphere, the Applicant would be required to obtain a gravel pit well permit in accordance <br />with C.R.S. § 37-90-137(2) and (11). Ground water exposed in an excavation at this site would <br />be tributary to the Middle Fork of the South Platte River. The South Platte River is an over- <br />appropriated stream system, therefore, a substitute water supply plan approved by the State <br />Engineer or a Water Court approved plan for augmentation must be obtained before a well <br />permif could be issued for a gravel pit excavation <br />
