The Applicant agrees to submit a monitoring program for static water levels prior <br />to dewatering any area on the subject site. <br />6.4.8 EXHIBIT H -Wildlife Information <br />18. Rule 6.4.8(2) imposes duties on State of Colorado administrative agencies, in <br />which the Applicant has no role. Our initial adequacy response did note that the <br />Division of Wildlife has discussed the Green/Croissant application with the <br />Applicant's representative. At that time, the Division of Wildlife's comments were <br />congruent with comments already covered within the scope of this adequacy <br />review. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />19. The Applicant has the reviewed the DMG reclamation cost estimate and will <br />defer to this result. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />22. The Croissant Family Trust owns the tailwater ditches. The Applicant will obtain <br />a Structure Agreement with the Croissant Family Trust, allowing for mining closer <br />than 200 feet form the structure.
