• Green/Croissant Sand and Gravel Mine, SeconaResponse to Adequacy Review
June 14, 2001
Page 3
6.4.7 EXHIBIT G -Water Information
17. The Applicant agrees to submit a monitoring program for static water levels prior
to dewatering any area on the subject site.
6.4.8 EXHIBIT H -Wildlife Information
18. Rule 6.4.8(2) imposes duties on State of Colorado administrative agencies, in
which the Applicant has no role. Our initial adequacy response did note that the
Division of Wildlife has discussed the Green/Croissant application with the
Applicant's representative. At that time, the Division of Wildlife's comments were
congruent with comments already covered within the scope of this adequacy
review.
6.4.12 EXHIBIT L -Reclamation Costs
19. The Applicant has the reviewed the DMG reclamation cost estimate and will
defer to this result.
6.4.19 EXHIBIT S -Permanent Man-Made Structures
22. The Croissant Family Trust owns the tailwater ditches. The Applicant will obtain
a Structure Agreement with the Croissant Family Trust, allowing for mining closer
than 200 feet form the structure. Prior to this, the Applicant will maintain a 200-
foot setback from these tailwater ditches.
If the above response to DMG adequacy concerns will require review beyond June 18,
2001, please also consider this a request for extension of the decision date in this case.
The Applicant is willing to waive its right to a decision until July 2, 2001 if necessary to
provide the DMG with time for satisfactory adequacy review.
If you have any questions or require additional information, please do not hesitate to
contact me at (303) 274-4277.
Sincerely,
~~~
Alex Schatz
Banks and Gesso.
