On behalf of our client, Trans Colorado Concrete (a Division of Pete Lien & <br />Sons, Inc.) we offer the following responses: <br />Exhibits Aand B -Adequate. <br />Exhibit C: <br />A. There is no disputed property ownership within the permit boundary. A portion of <br />property within Section 6, T21S, R62W, 6`" P.M., Pueblo County (shown on <br />Exhibit C-3 with a note "ownership in this area is being researched" and located <br />north of the existing Arkansas River bed and south of the permit boundary), may <br />either be owned by Dominic and Margaret Cingoranelli (as shown in the Pueblo <br />County Assessor's records) or Kenneth Koslowski et al. (as shown in the Title <br />Commitment included with this application). In either case, the disputed <br />property is not included in the permit boundary, and the Cingoranellis were <br />properly notified as a potential property owner within 200 feet of the permit <br />boundary, as shown in my letter to you dated April 8, 2004. <br />B. Yes. Permanent man-made structures located within 200 feet of the affected <br />area were listed in Exhibit S of the original application package, and were also <br />located and listed on Exhibit C-1. <br />III. Exhibit D: <br />A. Truck haul will be used initially to move excavated material to the processing <br />plant. It is possible that Feld conveyors will be used as the working face of the <br />mine moves further away from the plant. The applicant proposes a maximum <br />conveyor belt width of 42 inches, and a maximum length of 2000 feet. <br />B. The applicant discussed appropriate river setback with both the Pueblo County <br />Planning Staff, and the U.S. Army Corps of Engineers. Both entities verbally <br />
