THIS PERMIT is issued by the Mured Land Reclamation Board, Departmerrt of Natural Resolrrrzs,
State of Colorado.
RECITALS
A. The Pemlittee, American Cancrete and Gravel, LLC desires to conduct a nrirrrtrg operation
lmown as Sea Horse Ranch West Grave Pit, for the purpose of exttactirlg sand and aggregate. The Permittee will
not mine any secondary commodities.
B. On April 22, 2002 the Mined Land Reclarnati~ Board (the "Board") approved the Pemrittee's
application for this pemlit, fixed the amount of the financial warrarlty and directed that this pemut be issued upon
the filing with the Division of Minerals and Geology (the "Division") of performance warranty and financial
warranty {or warrarrties) in the amount so fixed in form and substance approved by the Divisio^. Said wanaMies
have been filed with the Division.
C. Lsthe Pennittee desires to extract materials other than those listed in (A), a separate pemlit may
be required.
D. On April 22, 2002 the Board made the following findings:
I. The application for this permit complies with the requirements of the Colorado Mined
Land Reclamation Ad for the Extraction of Construction Materials, C.RS. 34-32.5-101 et sue., as amended, and
with all applicable local, state and federal laws;
2. The operation will not adversely affect the stability of any sigrificarrt, valuable, and
peananerrt man-made structure located within two hundred feet. of the Affected Land, exc~t where there is an
agreement between the Operator and the persons having an irrterest ur the structure that damage to the stmcture is
to be compensated for by the Pemli[tce; and;
