Cattany <br />Acting Division Director <br />THIS PERMIT is issued by the Mured Land Reclamation Board, Departmerrt of Natural Resolrrrzs, <br />State of Colorado. <br />RECITALS <br />A. The Pemlittee, American Cancrete and Gravel, LLC desires to conduct a nrirrrtrg operation <br />lmown as Sea Horse Ranch West Grave Pit, for the purpose of exttactirlg sand and aggregate. The Permittee will <br />not mine any secondary commodities. <br />B. On April 22, 2002 the Mined Land Reclarnati~ Board (the "Board") approved the Pemrittee's <br />application for this pemlit, fixed the amount of the financial warrarlty and directed that this pemut be issued upon <br />the filing with the Division of Minerals and Geology (the "Division") of performance warranty and financial <br />warranty {or warrarrties) in the amount so fixed in form and substance approved by the Divisio^. Said wanaMies <br />have been filed with the Division. <br />C. Lsthe Pennittee desires to extract materials other than those listed in (A), a separate pemlit may <br />be required. <br />D. On April 22, 2002 the Board made the following findings: <br />I. The application for this permit complies with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.RS. 34-32.5-101 et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any sigrificarrt, valuable, and <br />peananerrt man-made structure located within two hundred feet. of the Affected Land, exc~t where there is an <br />agreement between the Operator and the persons having an irrterest ur the structure that damage to the stmcture is <br />to be compensated for by the Pemli[tce; and; <br />
