Lnnq <br />D rvumn Direuor <br />The Division of Minerals and Geology received your Notice of Intent <br />to Explore for Coal for the 1993 Dry Creek Project. Under Rule <br />2.02(2) the Division finds your application complete for purposes <br />of filing. <br />The Division has a few adequacy concerns that Peabody needs to <br />address before the Division can make a decision regarding the <br />application. <br />1. Peabody states in the application that existing roads <br />will be utilized for access to the exploration drill holes and <br />monitoring well. Please state if Peabody plans to significantly <br />alter the roads for access to the drill sites including change of <br />grade, change of route or widening of the roads. Refer to Section <br />4.21.4(3)(c) for further clarification of this requirement. <br />2. Please state how Peabody plans to conduct coal <br />exploration in a manner which minimizes disturbance of the <br />prevailing hydrologic balance. Such sediment control measures are <br />listed in 4.05.5 of the Colorado Rules and Regulations, <br />3. Peabody states that topsoil will be salvaged prior to <br />drilling the exploration holes and monitoring well. Please state <br />how topsoil will be stored and stabilized to prevent erosion. <br />4. Reclamation of the monitoring well does not address the <br />removal of the PVC pipe. Please address how Peabody will cut or <br />remove the portion of the PVC pipe in accordance with Rule 4.07. <br />5. Please state if blasting operations will be conducted <br />within 1,000 feet of any building or 500 feet of an active or <br />abandoned underground mine. The use of explosives must comply with <br />Section 4.08 of the Colorado Rules and Regulations. <br />
