Long <br />Division Director <br />RE: Adequacy Issues, Stone Gravel Pit, Permit No. M-97-089. <br />Dear Mr. Stone: <br />Application for the Stone Gravel Pit was found complete for the purposes of filing on <br />10/1/97, Pursuant to Rule 1.4.5(3), DMG decision date has been set for 12/30/97. <br />Stone Gravel Pit application was not adequate for approval as originally submitted. Please <br />respond to the adequacy issues identified within this letter prior to DMG decision date to <br />allow sufficient time for DMG to finalize its review process. <br />ADEQUACY ISSUES <br />1. Public Notices -Permit documentation indicates that applicant provided notice, <br />described by Rule 1.6.2(1)(e), to Bell, BLM, Emerson, Lewis, Messinger, Morris, Olin, Trost <br />and Ute Mountain Tribe. DMG has received Proof of Notice for Emerson. Please provide <br />Proof of Notice, described by Rule 1.6.2(1)Ig), for the remaining parties. <br />2. Permanent Man-Made Structures -Permit documentation indicates that the fence and <br />gate, forming the south permit boundary, and the existing north and south BLM access <br />roads, are located within 200' of affected lands. Please provide the notarized damage <br />compensation agreement OR the appropriate engineering evaluation, required by Rule <br />6.4.19, for the south boundary fence and gate, and the existing north and south BLM <br />access roads. <br />Locations of north and south BLM access roads and south boundary fence and gate <br />are highlighted and labeled on the attached copy of the Reclamation Map, Exhibit F. <br />3. Existing Roads as Affected Area -Rule 1.1(3) requires that pre-existing roads be <br />included as affected land, if the existing roads will be substantially upgraded to support <br />mining operations.
