The <br />Ride includes minimum requirements for determining the amounts and Qeriods of liability for performance bonds: <br />it establishes tniitimutn standards for the form, conditions, and terms of performance bonds; it sets forth minimum <br />provisions for criteria, schedule, and procedures for release of performance bonds; i[ establishes provisions to be <br />applicable whenever a proceedin¢ for the forfeiture of all or anv part of a performance bond, as a result of a failure <br />to meet the conditions upon the bond, is initiated; and it sets forth special requirements for construction of certain <br />min drainage control facilities. <br />RESPONSE <br />Twentymile Coal Company (TCC) is currently bonded for the surface disturbance and reclamation of the <br />Foidel Creek Mitte under The AETNA Casualty and Surety Company, Bond Number 64S100203392BCA <br />for the amount of $7,1 15,700.00. Additional security required due to the new mining activities planned in <br />this permit revision application will be obtained and submitted to the CMLRD in accordance with Rule <br />3.02.
