<br />MINERAL LEASE <br /> <br />THIS Iv[INERAL LEASE ("Lease") is made and is effective as of / Y , 2000, <br />by and be~veen the parties hereinafter named, for the term and upon and under the terms and <br />conditions hereinafter set forth. <br />Parties. The parties to this Lease, and their addresses for all purposes hereof, are: <br />(a) LESSORS: Jessie M. Grisenti, James J. Grisenti and Joseph A. Grisenti. (collectively <br />"Lessors"), whose address is 15000 Highway 115, Florence, Colorado 81226; and (b) LESSEE: <br />Castle Concrete Company, whose address is 7250 Allegheny Drive, Colorado Springs, Colorado <br />80919. <br />2. Grant of Lease. <br />(a) Lessors represent and warrant that they are the owners in fee of certain <br />Property situated in Fremont County, Colorado, more particularly described on Exhibit "A" <br />attached hereto (the "Property"), consisting of 226.2 acres, more or less. In addition, there are <br />water rights appurtenant to the Property known as the Lester-Atterbury water rights. The <br />Property, e.ecluding the appurtenant water rights, but together with the sand and gravel reserves, <br />other minerals, overburden, topsoil, loose rock or any combination thereof on or contained within <br />the Property or formed in association therewith and any portion or part of any earth, rock, or <br />other material that maybe attached, combined with, or constitute a part thereof, to the extent that <br />any of the foregoing occur and are found between the surface and top of the uppermost <br />underlying stale formation (the "Leased Strata"), are the subject of this Lease and are hereinafter <br />referred to together as the "Property and Mineral Rights." However, Lessors shall permit <br />Lessee to utilize as much of said Lester-Atterbury water rights as Lessee determines let needs in <br />connection with its mining operations on the Property without chazge to Lessee in exchange for <br />r\Icga I~w A ~'kast IeJcase.
