Long <br />Division Director <br />RE: San Acacio Pit (File M-99-024) 2"° adequacy review of 110 permit application <br />Dear Ms. Pacheco: <br />The Division has received and reviewed Mathew Valdez's May 18, 1999 response tD the Division's I"adequacy <br />review of the application for the San Acacio Pit. Certain adequacy issues were satisfied by the response and others <br />remain. The status of the adequacy concerns indicated in the Division's 1"adequacy review is as follows: <br />PAGE 2 OF APPLICATION: This adequacy concern regarding the location of the pit is satisfied. As <br />indicated earlier. the Division will accept the metes and bounds description of the proposed permit area supplied in <br />Exhibit A and as illustrated on the survey plat provided by Luchetti Land Surveying, Inc. Althoueh the Division is <br />not familiar with the "Costilla Estates Survey", use of which is made on Page 2 for locating the pit, the Division <br />will also accept that the location provided on Page 2 is valid for the area of the pit. The Division, however, remains <br />interested in determining the relationship of the Costilla Estates Survey and that based on the 6'" Principal Meridian <br />as well as the extent of the Costilla Estates Survey. <br />PAGE 2 OF APPLICATION: This adequacy issue regarding post mining land use is no[ satisfied. In <br />order for the Division to accept the identification of the post-mining land use of the mine site as <br />Industrial/Commercial, the Division must have evidence that the permit area is zoned by the County for such. The <br />information so far provided establishes the zoning of the site as being Agricultural. <br />Please change the post-mining land use to something compatible with the County's Agricultural zoning for <br />r~j <br />the proposed mine site. <br />EXHIBIT B, Section (b): This adequacy issue regarding the existence of permanent man-made structures <br />within 200 feel of the affected area has been satisfied by the response. <br />EXHIBIT C, Section (b): This adequacy issue regarding topsoil salvage is not satisfied. You have <br />indicated your awareness of the existence of some topsoil in the area to be affected by the mining operation and that <br />you plan to stabilize the topsoil with vegetation. You have also indicated in your response to the Division's Exhibit <br />D, Section (c) (i) adequacy concern, that you consider a thickness of I-2 inches of topsoil as insufficent For <br />p~ reclamation purposes. You have then indicated that, under such circumstances, you will import and distribute 3 to 4 <br />inches of topsoil. You have not, however, committed to salvaging and stockpiling the topsoil available onsite. <br />Please indicate if you plan to salvage and stockpile the topsoil available at the site or, if only I l0 2 inches <br />are encountered, that you do not intend to do so and will rely on imported topsoil For your reclamation. <br />EXHIBIT C, Section (c): This adequacy issue regarding overburden thickness has been satisfied by the <br />response. <br />~8 <br />
