mining operations without obtaining a reclamation permit from the Division, in violation of <br />the Colorado Mined Land Reclamation Act for the Extraction of Construction Materials (the <br />"Act"). Because of this and other violations of the Act and the Construction Materials <br />Rules, the Board issued a Cease and Desist Order to the Applicant at an October 29, 2003 <br />hearing on this matter. The Cease and Desist Order ordered the Applicant to cease mining <br />operations until it obtained a mining permit from the Division, seek reconsideration ofits <br />original reclamation permit approval from the Board by December 17, 2003, post an interim <br />reclamation bond of $240,000, and pay specified civil penalties. <br />4. The Division has reviewed the record in this matter and recommends that the Board approve <br />the Applicant's request for reconsideration.
