BANTA, Dlreotor <br />August 23, 1989 <br />Ms. Sandra PautsKy <br />Pueblo Goal, Inc. <br />400 First National Building <br />Wichita Falls, texas 76301 <br />RE: Caroon Junction Mine, C-82-054; <br />Permit Renewal and Civil Penalties <br />Dear Ms. PautsKy: <br />To date the Division has not received a response to our letter of 7/26/89 <br />concerning bond recalculation for the Carbon Junction Mine. It should oe <br />pointed out that Pueblo Coal does not hold a valid mintnq and reclamation <br />permit for the Carbon Junction Mine since Lne existing permit expired, The <br />renewal application was not submitted 180 days Drior to expiration of the <br />permit, therefore, Carbon Junction did not meet the requirements for <br />administrative delay. <br />Since no valid permit exists at the site the Division neetls to proceed witn <br />resolution of the Carbon Junction renewal application. An opportunity was <br />provided to allow Caroon Junction to suomit a recalculatetl estimate of the <br />reclamation Dona and you have not responded. Therefore, we must request that <br />additional Dond coverage in the amount of 5194,150.00 be submitted to the <br />Division Dy October 6, 7989. We will still evaluate any revised estimate <br />suomitted p n or to that Gate. <br />In addition, it nas been Drought to my attention that payment of a civil <br />penalty in the amount of $70C,00 for Violation C-89-005 is past due. Tne <br />Divtslon can not issue a positive renewal decision until tnat penalty is paid. <br />Failure to resolve this issue will result in the Division recommending denial <br />of the Caroon Junction permit renewal to the Colorado Mined Land Reclamation <br />Board.
