Dear Mr. Heifner:
I have been retained to represent a group of homeowners who
have property either immediately adjacent to or near the above
proposed open pit mining operation. Please consider this
letter a formal objection to issuance of a permit by your
department. We intend to submit a written protest outlining
the reasons for this objection.
This letter is to request that hearing of this application
which at present is scheduled for Steamboat Springs on
September 27 and 28 , 1978 , be cancelled. To support that re-
quest, we submit the following :
1. The Legal Notice published in the Greeley
Tribune August 10 , 17 , 24 , and 31, 1978 ,
stated that the hearing is scheduled for
September 27 or 28 , 1978 at 1313 Sherman
Street, Denver, Colorado.
2 . The distance required for objectors to
travel in order to be present and partici-
pate in that hearing creates undo hardship.
3 . Owners of property lying immediately adjacent
to the affected land did not receive notice
of said hearing as required in 2 . 22 of the
Board 's Rules and Regulations and C.R.S,
1973, 34-32-112 (10) (c) , as amended.
Thank you for your consideration in eliminating this item from
the meeting agenda on September 27 and 28 . I would appreciate
hearing from you at your earliest convenience as to the decision
in this matter.
