In conformance with Rule 6.4.7(3), the applicant states on page 25 that they will forwazd <br />complete calculations of project water requirements after they have submitted the application <br />for a temporary substitute supply plan for review to the Office of the State Engineer. If at all <br />possible, such project water requirements should be defined and submitted to the Division <br />prior [o the February 18, 2002 decision date. Please respond. <br />10. The applicant states on page 25 that the wash pond will be about 4 acres in size and on page <br />24 that water from dewatering operations will be pumped and discharged into a pond on-site <br />then to an outlet ditch to the South Platte river. In conformance with Rule 6.4.7(2)(c), please <br />provide a plan view and cross-sectional designs for the wash pond and dewatering system. <br />Such information may be included on the revised mine plan map. Please respond. <br />11. The applicant indicates on page 26 that a permit from the Colorado Health Department to <br />dewater the mine site is currently being applied for and will be forwarded to the Division <br />upon receipt. The Division appreciates the applicant/operator forwarding such information <br />when available. Also, in conformance with Rule 3.1.6(1)(b) please provide a commitment to <br />securing an NPDES permit from the Water Quality Control Division prior to any offsite <br />discharge at the NCCI Pit No. 1. Please respond. <br />6.4.10 EXHIBIT ,T - Vesetation Information <br />12. The applicant mentions on page 52 that the vegetation at the site consists of pasture grasses, <br />noxious weeds, and wetland species. In conformance with Rule 6.4.10(1)(a), please identify <br />the noxious weed species and primary wetland species present. Also, please clarify whether <br />there aze jurisdictional wetlands present that will be affected by the proposed mining and <br />reclamation activities. Please respond. <br />13. In the event there aze noxious weeds present, you will need to provide a noxious weed control <br />plan which includes specific control methods/strategies for each noxious weed species present. <br />This information is being requested in conformance with Rule 3.1.10(b). Attached is a copy of <br />comments received from the Platte Valley Soil Conservation District. Please respond. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />14. The reclamation cost estimate as provided on page 56 will need to be revised to include <br />topsoil reapplication costs for the desired depth of topsoil application (see Item 5 above), and <br />iterruzed costs for ripping, topsoiling, and revegetation of the processing and stockpile areas (see <br />item 6 above). Please respond. <br />
