Way Co. <br />117 White Pine Drive <br />Alamosa, Colorado 81101 <br />Re: Del Norte Pit <br />Our F11e No. M-84-026 <br />Dear Mr. Belt: <br />I have completed my adequacy review of the 110 permit application <br />Norte Pit. I have several questions and comments about this appli <br />I have organized on an exhibit-by-exhibit basis below. Any exhibt <br />thereof not mentioned is considered adequate now. Please respond <br />letter at your earliest convenience. Your response should be 1n o <br />no later than March 19, 1984. In this way, I w111 have time to re <br />conment, as necessary, before the scheduled March 22-23, 1984 meet <br />Mined land Reclamation Board. <br />Before the Board can consider this application, our Division must r <br />proof of the two sequential weeks of publication in a local newspap <br />(publisher's affidavit or copy thereof). Our Dl vision must also re <br />proofs of notifications to any immediately adjacent landowners (in <br />certified mall white or green receipts or copies thereof) before th <br />Board meeting. An examination of your ownership map seems to lndtc <br />the 8.88 acre permit area 11 es entirely within your own land, with <br />exception. The 90' haul road connects to State Highway 374. This <br />the Colorado Division of Highways should be notified as an ad,)acent <br />landowner. Unless the boundaries of the proposed permit area actua <br />the boundaries of the lands owned by those nearby landowners shown, <br />landowners need not be notified. Please clarify this situation and <br />the appropriate proofs of notification. <br />Exhibit A <br />1. The 90' x 30' access road should be added to the legal descri <br />some manner.
